In a welcome move, the Allahabad High Court on Thursday has said that the practice of Triple Talaq is constitutional and violates the rights of the Muslim women.
The top court has further affirmed that “No Personal Law Board is above the Constitution.”
The Central government had earlier said its stand on triple talaq is perfectly in sync with the spirit of the Constitution and that it completely supports the principles of gender equality and justice.
In the month of September, the All India Muslim Personal Law Board (AIMPLB) told the Supreme Court that personal laws of a community cannot be “re-written” in the name of social reforms. The Board had also opposed the petitions including those that claimed that Muslim women face gender discrimination in divorce cases.
